| Co-Op Advertising Program Feature Markwort logo items in your ads, and/or the specific feature items listed below, and we'll pay 50% of your cost. There's a limit on the amount we'll pay you - 2% of the cost of only Markwort brand and the specific feature items bought this year from Markwort. OFFER Markwort Sporting Goods Company agrees to provide a fund for use in local advertising. The fund will be equal to two percent (2%) of the dollars billed to this account (excluding sales taxes and freight charges) and paid purchases of only Markwort brand products and these specific feature items: 19c Baseball?, Acme Whistles, Block Shock ™, C-Flap®, Cannon Ball, Catch-Tek, Direct Protect®, EMask®, EGuards®, Fox 40 Whistles, Frozen Ropes Balls, Fuzz Ball ™, Game Face®, Glove Guard®, Glove Locker™, Golf Power Swing, Gridiron, Heart-Gard®, Helmet Tree, Kool Kollar, Lion Table Tennis, Maya Footbags, POW™ Balls, Original Practice Glove, Palmgard®, The Perfect Circle, Perfect Stride, Pivot Pro, Power Fins, Power Punch®, Power Swing®, Pure Shooter, ReLacer™, Rotor Twin, Safe-T-Ball®, Score-All Scorebooks, Shock Stop™, SportCups®, STASH®, STASH®Z3 and STASH®eps Hand Protection System, Storm® Whistles, Team Caddy™, Throw-Rite™, totes®, Ultimate Bags, Upper Hand™, Windstorm® Whistles, and Vettex Mouthguards purchases. This total must be matched with a like sum by the retailer. ELIGIBLE PRODUCTS All Markwort® brand products are eligible for the advertising part of this program, in addition to the specific feature items listed above. AUTHORIZED MEDIA All recognized circulation, general interest daily, Sunday and weekly newspapers automatically quality for use in this program, provided the newspapers have primary coverage in the retailers trading area, they have second or third class mailing permits, and their rates and circulation are published and can be verified through an independent audit. The use of television and radio is also authorized, but broadcast charges may not exceed the published spot advertising rate for the time period involved. No charges for program sponsorship, remote broadcasts, talent, production or agency fees may be included. Direct mail pieces and mail order catalogs will also qualify for payment providing that reasonable charges for the Markwort parts of such media costs can be verified, and all other advertising requirements as specified are met. ADVERTISING REQUIREMENTS The Markwort name must appear in the headline or sub-head of the advertisement. The registered mark symbol, ®, must follow the Markwort name. The retailer is urged to use the Markwort registered trademark logo. All advertisements must be illustrated. When other competitive products appear in advertising with Markwort products, only that part devoted to Markwort products will qualify for credit. Advertising may feature only current Markwort first-quality merchandise. If a specific feature item is used, the registered mark symbol, ®, and trade mark symbol, TM, must follow the product name, where applicable. (See Eligible Products, above, for complete listing.) Use of the product logo is recommended. In broadcast advertising, commercials must be devoted exclusively to Markwort and must be devoted exclusively to Markwort and must be at least :30 in duration. The Markwort name must be mentioned at least three times in radio advertising and television advertising, and television advertising must conform to advertising guides adopted by the Federal Trade Commission. Advertising which does not conform will be rejected. ADVERTISING DATES The retailer agrees to advertise only eligible products between January 1and December 31. All advertising run between these dates, proof of same being received by Markwort by March 1 will be processed for a credit to be applied to your account, or a check direct from Markwort Sporting Goods Company. SHIPMENT DATES Eligible product shipped from January 1 through December 31 from Markwort Sporting Goods Company qualifies for program. PAYMENT The full cost of all verified advertising claims, up to the limits of the established fund, will be credited directly to the account, provided the account is current. Claims for newspaper advertising must include a complete tear sheet of each ad, together with the retailer's invoice from the medium with the name of the newspaper, date of ad, size of ad, and the retailers (local) advertising cost. Broadcast advertising must include a station invoice identifying Markwort as the subject of the commercial together with a copy of the script as aired and a notarized affidavit providing details of airing.
